Income Tax – A Myopic View

Today was Budget day…Million of Salaried Indians were glued to TV, Websites etc just to know if any changes proposed in Income Tax Slabs…A Carot is given to this unfortunate lot (Salaried Class)..Now u must be wondering why this class is unfortunate, reason being for Salaried class Income Tax is mandatorily deducted at source (TDS). To understand better let me share some facts

India has population of 117 Cr, Only 3 Cr people pay tax in india and majority falls between tax bracket of 3 Lac to 5 Lac (Income bracket). As per some estimates approx 26% people are BPL (Below Poverty Line) in India and  14% people earn less then taxable income so we are left with approx 70 Cr people..Assuming average family size of 5 and 1 earning member…3 Cr people who are paying tax are taking care of 15 Cr people…Now we are left with 55 Cr people…Again assuming 1 member feeding total 5 members so which implies 11 Cr people in India are falling under Tax bracket but not paying Tax.

Question arises who are these people

1. Farmers/Agriculturist: India’s 40% people are dependent on farming sector i.e. approx 47 Cr…Effectively out of 55Cr non tax paying population, 47 Cr are directly or indirectly linked to farming…Now we understand that this community barely meet their ends but its not true for 100% of community…Approx 30% Farming community is rich, atleast Govt. can tax the Big Fishes…The biggest question is why govt is not taxing them, Answer is very simple Politics.

2. Rest 8 Cr are linked to Business and other activites where Govt either does not have any control or very minimal control to impose tax regulation. To give e.g. how many of us take proper tax invoice from next door Kirana shop  answer is none or minimal..As per rule he has to give tax invoice for all transactions which is not happening so indirectly we all are responsible for this situation.

Now only class on which Govt has full control is salaried class where Tax can be deducted at source that is why this class in unfortunate becoz this class cannot escape tax net.

In real sense, these 3 Cr tax payers are carrying the burden of rest 114 Cr population..Which is one of the prime reason for very high Fiscal Deficit..If everyone start paying Income Tax honestly then there is no reason, Govt has to struggle for funds..

Another biggest disadvantage for salaried class is that they are paying double tax…Suppose a person A fall in 30% tax bracket so out of 100 Rs he earned, he paid 30 Rs tax (For simplicity, i am excluding cess)…He is left with 70 Rs and pls note salary is already taxed. Now he decides to buy a TV & other items for his family which cost 61 Rs and he has to pay VAT @ 14% to buy these so he need to shell out 9 Rs VAT…

Now lets do total calculation, he has earned 100 Rs and he paid tax twice i.e. 30 Rs + 9 Rs  = 39 Rs..So his net tax is 39% not 30 Rs becoz he paid double tax…Effectively its double whammy for salaried class becoz of double taxation…In many countries it is avoided by allowing tax payer to claim deduction on taxes paid from already taxed salary.

To wipe off fiscal deficit, Govt shud think ways of increasing Tax Net by bringing all the people earning above minimum threshold  in Tax net and also take steps to avoid double taxation so that tax payer community (Mostly middle class) can sigh relief.

Salary Class` agony is rightly described with calculations. When DA is increased after 6 months (however multipied amount is snatched by many hands of MEHNGAI MONSTER) there is hue & cry in media about the burden on Govt. but there is no one to tell the agonies of this class. You descibed it very well. .

Hi Nitin,

Unfortunately I did not find right thread to post my queries on ITR:

I am Salaried & pay tax via TDS, I have form 16 for FY 2011-12 & 2012-13, can I file a return for this old form 16 along with this year form 16 (FY13-14) which I am going to get shortly, please guide.

What would be the easiest way, I live in Bangalore.

Please suggest if some good online websites are available.

For FY 2011-12 (AY 2012-13) & FY 2012-13(AY 2013-14) today is the last date to file return without any penalty. You can visit any nearest income tax office to file the return. Normally IT department organize multi-counter camp at Palace Ground in Bangalore for the benefit of General Public. You may contact Income Tax helpline of Bangalore to get more details. No is 080-22860719

If you wish to file online than you may do so for free on Income Tax department website only. The link is https://incometaxindiaefiling.gov.in

It will hardly take 10 mins to file a return if all details are available with you.

Yesterday submitted both ITR-Vs. I have few queries here:

1. Why is it mandatory to file return every year though the refund amount is zero?

(In my case it is zero for both ITR-Vs because my employer deducts it via TDS & I have filled ITR-1 form with just 2 values:
=>Amount under 80C
=>& Gross income (As per my form-16 Gross income = Gross salary – exempted – PT))
TAX got auto calculated & displayed return zero for both years.
TAN of deductor also got auto-populated & displayed same amount of tax paid as per my form-16.

2. Is it ok to send both ITR-Vs in same envelope to CPC?

3. If we join new employer in March, he doesn’t deduct TDS, He starts deducting from April (new FY), Will Income tax department takes any action for IT not paid for March, If yes what precautions can be taken?

1. It is mandatory to file Income Tax return under Income Tax Act, 1961 even if you are not claiming any refund or tax payable is Nil.
2. Ideally it should be sent in 2 envelops as you have proof that you have sent two different copies.
3. You need to calculate total taxable income by combining income from Past & current employer. Any tax payable should be paid as self assessment tax before 31st July i.e. before filing returns for the FY. If you have paid all taxes for FY either through TDS or self assessment tax, IT department will not bother you.

You can start an online petition. The business guys have more avenues to save tax compared to salaried class.

This data is not entirely correct.
3 Cr people are not paying taxes…but filing the returns…Only 1.2 crore people pay the taxes….1.8 crore people file 0 tax return. So, total 1.2 crore out of 125 crore people..which is around 1% people.

Salaried class are big sufferer and should not be taxed twice in the name of VAT, Toll Tax etc. Gov. should bring business men who are multiplying their income every year and paying very little amount or not paying.
